By using the Shantaliving Platform (“User” or “You”), you acknowledge and agree to be bound by the terms outlined in this agreement (“Agreement”). Failure to accept these terms implies that the Agreement is not finalised, and consequently, you are not authorised to use the Service (as defined below).

Otherwise, your continued use of the Services constitutes acceptance of such changes.

Our Services:

The Shantaliving Platform (“Platform”) is a service provided and managed by Shantaliving Technologies Solution, enabling Users to enhance the intelligence of their products.

User’s Account:

Users wishing to create an account will be assigned a unique username (email address) and password. Alternatively, accounts can be created using email addresses provided by third-party identity providers such as Google, subject to User approval. By creating an account, you affirm that: (i) all necessary registration information provided is accurate and truthful, and (ii) you will maintain the accuracy of such information. Shantaliving reserves the right to suspend or terminate accounts for any breaches of this Agreement. You are responsible for maintaining the confidentiality of your account login details and are liable for all activities conducted under your account. Prompt notification to Shantaliving of any unauthorised or suspected unauthorised use of your account is required. Shantaliving shall not be held liable for any losses or damages resulting from failure to comply with these requirements.

The User’s duties:

3.1. Under compliance with this Agreement, you are granted a limited, non-exclusive, non-assignable, non-transferable licence to utilise and access the Service. When creating, modifying, or publishing content, such as software or libraries (“Content”), you must adhere to the terms of this Agreement and applicable legal provisions, observing principles of good faith, truthfulness, and fairness.

3.2. The User agrees to use the platform solely in accordance with this Agreement and for the purpose of utilising the Services. Specifically, you agree not to:

(i) Transfer or resell the Services or your right to use the platform to others.

(ii) Interfere with or operate on the platform hardware without Shantaliving’s intervention and authorisation.

(iii) Utilise the Platform if your account has been temporarily or permanently suspended.

(iv) Create or incorporate other datasets correlated to Shantaliving for a service similar to the Service.

(v) Provide Shantaliving with false, inaccurate, or misleading data, particularly during account registration.

(vi) Disseminate viruses, malware, or any technology designed to harm the Platform or other Users’ devices, or to disrupt the Services’ use.

(vii) Copy, modify, or disseminate the content of the Platform documentation, Apps, Services, or proprietary information belonging to Shantaliving and/or others, except open-source software.

(viii) Use any mechanism, software, or procedure that interferes with the proper operation of the Platform.

(ix) Circumvent security measures prepared by Shantaliving to ensure the Platform’s security and prevent unauthorised access.

(x) Upload or communicate offensive, vulgar, violent, false, or harmful content through the Platform, infringing Shantaliving’s image or third-party rights, or contrary to the law.

Use of the Services:

4.1 Shantaliving is committed to maintaining the Platform’s accessibility and functionality, offering technical support to resolve issues related to Account usage due to platform-related problems. Users can seek assistance via email at shantalivingtech@gmail.com However, Shantaliving shall not be held responsible for access issues arising from factors beyond its control, including:

(i) Connectivity and continuity issues with the User’s internet traffic;

(ii) Problems with the User’s IT systems;

(iii) Malfunctioning or incompatible devices used by the User;

(iv) Interruptions in the User’s internet network access;

(v) Incompatibility between the User’s device or browser and the platform;

(vi) Any other events not caused by Shantaliving.

 4.2 While using the Services, Users may encounter discrepancies between actual conditions and those indicated within the Platform’s accessible data. Users acknowledge and accept the need to exercise their judgement independently of the Platform’s functions, assuming personal responsibility and associated risks for their conduct and consequences.

4.3 The Platform may contain links to third-party websites not directly controlled or managed by Shantaliving. Shantaliving bears no responsibility for the information or User browsing on these third-party operated websites.

Publishing Content and moderation:

5.1 By submitting information or publishing content through the Platform, Users grant Shantaliving a non-exclusive, unlimited, transferable, sub-licensable, and irrevocable right to use the content for various purposes, including reproduction, modification, distribution, and creation of derivative works, globally.

5.2 Users are solely liable for the content they publish or submit to Shantaliving and agree not to publish any content that is false, illegal, misleading, defamatory, or violates intellectual property rights.

5.3 Users waive any objections to Shantaliving’s use, modification, deletion, or distribution of the content and permanently relinquish any claims regarding such content.

Industrial and Intellectual Property:

6.1 Users acknowledge that:

(i) Shantaliving holds exclusive intellectual and industrial property rights over the Platform, software, and related databases;

(ii) Shantaliving exclusively owns the Shantaliving project, associated know-how, and all technical and trade information related to the project, and Users agree not to infringe upon these rights.

6.2 All content on the Platform, including texts, artwork, images, and audiovisual materials, are protected by intellectual and industrial property laws and are either owned by Shantaliving or licensed by third parties. Users may download content for personal use only, subject to certain conditions, and must not modify, sell, or reproduce the content for commercial purposes without prior authorization. Unauthorised copying or use of Platform content on other websites or networks is prohibited without express written consent from Shantaliving.

Term and Termination:

7.1 This Agreement remains in effect indefinitely and will terminate in cases outlined below, including the closure of the Account and discontinuation of Service.

Suspension and Termination:

We reserve the right to modify, suspend, or terminate the availability or any functionality of the service at any time without prior notice and without incurring any liability. Additionally, we may impose restrictions on certain features or services, or limit your access to part or all of the Service without notice. Shantaliving may cancel the Account if the User breaches any obligations under this Agreement, following written notice, without prejudice to any other remedies provided by law or this Agreement.

Termination by You:

You have the right to terminate this Agreement at your convenience, for any reason or no reason at all, by discontinuing your use of the Service.

Effects of Termination:

Upon termination of this Agreement, all granted rights and licences will immediately cease. Neither party will be liable to the other for damages resulting solely from the termination of this Agreement.

Data Deletion:

Shantaliving will make reasonable efforts to delete your password, name, and all associated information within your Account (or any part thereof) upon termination of this Agreement or upon your request.

Privacy and protection of personal data:

The User’s personal data will be processed solely in accordance with the privacy policy statements available at https://www.shantaliving.in/.

DISCLAIMER AND LIABILITY:

Disclaimer. THE SERVICES ARE PROVIDED “AS IS,” “WHERE IS,” AND “WITH ALL FAULTS,” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, SECURITY, TITLE, AND NON INFRINGEMENT. Shantaliving DISCLAIMS ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES ARE FREE OF INACCURACIES, ERRORS, BUGS, OR INTERRUPTIONS, OR THAT THEY ARE RELIABLE, ACCURATE, COMPLETE, OR VALID. ANY CONTENT OR MATERIAL OBTAINED THROUGH THE SERVICES IS AT YOUR OWN DISCRETION AND RISK. YOUR USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGES ARISING FROM SUCH USE, INCLUDING DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA. NO ADVICE OR INFORMATION OBTAINED FROM US OR THROUGH OUR SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

Limitation of Liability. UNDER NO CIRCUMSTANCES WILL Shantaliving BE LIABLE TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE, SPECIAL, OR RELIANCE DAMAGES ARISING FROM THIS AGREEMENT OR THE SERVICES. SUCH DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, LOST PROFITS, REVENUES, AND BUSINESS OPPORTUNITIES, WHETHER OR NOT YOU WERE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.

Miscellaneous:

Independent Relationship:

Nothing in this Agreement creates an agency, employment, partnership, fiduciary, or joint venture relationship between You and Shantaliving.

Governing Law. This Agreement is governed by the laws of the People’s Republic of India.

Severability. If any provision of this Agreement is determined to be illegal, unenforceable, or invalid, the remaining provisions will continue in full force and effect to the extent permitted by law.

Assignment. Shantaliving may assign this Agreement to an associated company with the User’s consent.
